you need to research galactic commerce and then it should become available under build new module

its built on your legion base, you have to be a leader or officer to build it i think

When I'm building the commerce bay does the player pay for the costs or does it come out of the base funds?

when building ANY base module from the module list... the funds and any extra materials needed come out of your own pocket... not base funds
