If a legion doesn't need to recruit or have standard for recruitment ("shouldn[']t have any problem recruiting an[y]way"), they would obviously not use the feature and/or put on restriction on the recruitment so that it won't "making it more difficult for other legions to find members."
Therefore your worries are unfounded.
On the other hand, a top 50 legion doesn't mean it doesn't need more people. The statement might be true for top 10-20, but not all top 50. Alpha Legion, for example, only have 41 active(43 total) members with an average of 468. Now, this is definitely good compared to lower legions, but it would still be in the market for recruitment. It would be unfair for them to be unable to recruit when they have a need just like any other legion.
