Since it seems the idea of fixing the open recruit option seems to have been shunned for no real reason, how about we just lazily put a warning label next to the button instead?

That's stupid. Instead, after someone chooses it, have a message that says "This was a stupid option, dumbass" and then kick them out of the game.

Now now, that's a little harsh, implementing a banning script that the game does on its own to players just means fewer customers for Dan (less money for him) and the population of the game drops.

You get that some legions want open recruiting so they can get members easily, right? Why would we modify "open"? Don't like it, pick restricted. I don't understand how this is an issue.
